1. About These Terms

These Terms & Conditions apply to your use of the TESGO Training website and to the services we provide at our Penrith, NSW facility, including classes, memberships, intro sessions, and drop-ins. By using this website or training with us, you agree to these terms.

2. Memberships & Payments

• Membership fees are payable in advance, typically by recurring direct debit through our payment provider.
• It is your responsibility to ensure sufficient funds are available on your scheduled payment date. Failed payments may incur a dishonour fee from the payment provider.
• We may adjust membership pricing from time to time and will give you reasonable notice before any change affects your membership.
• The specific inclusions, minimum terms, and conditions of your membership are set out in your membership agreement.

3. Cancellations, Suspensions & Bookings

• Membership cancellations and suspensions must be requested in accordance with the notice period in your membership agreement.
• Classes should be booked through our booking system. Please cancel bookings you can't attend so the spot can go to another member.
• We may amend the timetable, coaches, or class formats from time to time.

4. Intro Week & Drop-Ins

Our Intro Week is available to new, local members only, one per person. Drop-in visits are intended for experienced athletes training away from their home gym, and are subject to class availability.

5. Health, Safety & Assumption Of Risk

• Strength and conditioning training involves inherent physical risks. You participate voluntarily and at your own risk.
• You must disclose any injuries, medical conditions, or limitations that may affect your training, and update us if they change. If in doubt, consult your doctor before training.
• You must follow coach instructions, use equipment as directed, and train within your capabilities. All sessions are scalable — tell your coach if something doesn't feel right.
• You will be asked to sign a waiver and health declaration before your first session.

6. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. To the maximum extent permitted by law, TESGO Training is not liable for loss, injury, or damage arising from your use of our facility or services, or for loss or theft of personal property brought onto the premises.

7. Code Of Conduct

We're a community first. We expect all members and visitors to treat coaches, fellow members, and equipment with respect. We reserve the right to refuse entry to, or cancel the membership of, anyone whose behaviour is unsafe, abusive, or contrary to the spirit of the gym.

8. Website Content & Intellectual Property

All content on this website — including text, images, branding, and programming materials — is owned by or licensed to TESGO Training and may not be reproduced without our permission. Website content is general information only and is not medical advice. Links to third-party sites are provided for convenience; we are not responsible for their content.

9. Privacy

We handle your personal information in accordance with our Privacy Policy.

10. Changes To These Terms

We may update these terms from time to time. The latest version will always be published on this page. Continued use of the website or our services after an update constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the jurisdiction of the courts of New South Wales.
